Trump's first-term MFN executive order directed Medicare drug payments to be tied to international reference prices. It was blocked in court and never implemented, but it established the legal and political architecture that this round of voluntary bilateral agreements is now operationalizing without requiring statutory change.
The Medicare Modernization Act prohibited Medicare from directly negotiating drug prices. The Inflation Reduction Act of 2022 partially reversed this for a narrow set of drugs. Voluntary MFN deals with individual manufacturers now circumvent the statutory constraint by making compliance a bilateral commercial arrangement rather than a regulatory mandate.
